Deportees and persons under custody

According to ICAO rules reflected in European and Portuguese legislation on civil aviation security, whenever the competent authorities decide to transport deportees or passengers in police custody, airlines must be notified in advance and in writing of the flight number and date of travel.

The written notification should include: 

  • the identity of the passenger (full name, gender, date of birth, nationality, passport number, validity)
  • reason for deportation
  • name and category of escort/s
  • risk, including reasons for accompaniment.
  • nature of documents available

The Potentially Disruptive Passenger Transportation Form must be completed and sent in due time to the TAP Security Department:

If these requirements are not met, passengers will not be accepted.

TAP sets a limit for deported passengers per flight:

  • 1 DEPU or,
  • 4 DEPA or,
  • 1 DEPU + 3 DEPA.

 

INAD - Inadmissible Passengers

INADs (Inadmissible Persons) are citizens of a third country who are refused entry to the territory of a State by the competent authorities because they do not meet the legal conditions for admission and who are transported back to the country where they started their journey, or, in case of impossibility, to any other country where their admission is guaranteed.

The authorities must notify the transporting airline in good time before the flight (preferably not later than 72 hours before) in accordance with ICAO Annex 9 reflected in EC Regulation 185/2010 and national law.

INADs are booked by TAP according to notification from the authorities.

Before issuing a ticket to a passenger, please ensure that the passenger has the necessary documentation for entry to the destination.

 

DEPA - Accompanied Deportees

DEPA (Accompanied Deportees) are persons in custody/deported accompanied by law enforcement official(s) while travelling internationally.

A deportee is a third-country national who entered or remained on the territory of a State irregularly or, having been admitted lawfully, has subsequently been the subject of a notification by the competent authorities for voluntary departure or a forced removal procedure from that territory.

Conditions of Transportation:

  • The condition of - DEPA - must be maintained from the origin to the destination of the passenger. E.g.: A passenger cannot be DEPA in AMSLIS and DEPU in LISSAO.
  • Only DEPA in economy class is accepted.
  • The journey of DEPA and accompanying persons must be confirmed in full.
  • It is mandatory to indicate the reason for deportation in SSR DEPA and the estimated risk (information to be provided by the authorities).
  • A special meal will be confirmed for escorts and DEPA as this is an internal company activity.
  • Seat reservation is mandatory and seats must be adjacent to each other.
  • If DEPA and Escorts are booked on separate PNRs, they must be cross-referenced in OSI TCP (Total Complete Party - total number of passengers) followed by their name and flight number respectively.

 

RECL - Prisoners

RECL is a person in custody travelling within Portuguese territory and accompanied by law enforcement officer(s). 

Conditions of Transportation:

  • RECL are only accepted on domestic flights.
  • RECL are not allowed to be carried on domestic sectors of international flights. 
  • The travel arrangements for both passengers and escorts must be confirmed in full.
  • It is mandatory to indicate the reason for travel on SSR and the estimated risk (information to be provided by authorities).
  • For escorts and RECL, a special meal will be confirmed, as this is an internal Company action.
  • Seat reservation is mandatory and seats must be adjacent to each other.
  • If RECL and Escorts are booked on separate PNRs, they must be cross-referenced in OSI TCP (Total Complete Party - total number of passengers) followed by the name and flight number respectively.

 

DEPU - Unaccompanied Deportees

DEPU are deported persons who, as they are not considered to be a troublemaker, are not accompanied by law enforcement officer/s.

Conditions of Transportation:

  • Only one DEPU is accepted per flight.
  • 1 (one) DEPU may travel in Business Class.
  • A special meal for the DEPU is confirmed (action taken byTAP).
